"Kicking the trade" is a tactic employed by certain auto dealers
in which car buyers are advised to stop making payments on an
underwater car loan in lieu of trading in the same vehicle prior
to purchasing a new car. On the surface, this may make some
sense, but it often results in the buyer being responsible for
two loans as the original lender seeks to recoup its losses.
There is some question as to whether this practice is illegal or
simply shady, and a portion of my coming article seeks to answer
that in the definitive, as well as providing potential avenues
of recourse for those who have fallen victim to this
unscrupulous tactic.
